Why we need your information

The data on this form is being gathered for the purpose of processing Chaperone applications.  Hertfordshire County Council will use this information to ensure that the chaperone is working in accordance with the regulations.

Hertfordshire County Council is obliged to collect and process this data under The Children (Performances and Activities) (England) Regulations 2014

What we will do with your information

The information you give us will be held by the Children’s Services; Integrated Services for Learning department of Hertfordshire County Council and will only be used to process applications for chaperones.  In order to deliver this service, we may share your information with other local authorities, TV/Theatre Producers, Production Organisations, between departments and services within the council so that we can keep our information up-to-date, provide cross departmental support, and to improve our services to you.

We may also share information with third parties if we are legally obliged to do so, for example if it necessary to safeguard or protect a child.
We may also share information with the police or other agencies if it is necessary for the following purposes:

  • the prevention or detection of crime
  • the apprehension or prosecution of offenders
  • the assessment or collection of any tax or duty or any imposition of a similar nature.

How long we will keep your information

Any information and supporting paperwork submitted as part of your application will be retained for two years

What are your rights?

Hertfordshire County Council will be the Data Controller for this information.

You have the following rights in relation to this data:

  • You have the right to be informed about what information we hold about you and how we use it.
  • You have the right to request copies of any information the Council holds about you by making a subject access request.
  • If information we hold about you is factually inaccurate you have the right to have it corrected.
  • You have the right to object to the way we are using your data.
  • You have the right to request that your data is deleted. However, we may be unable to delete your data if there is a need for us to keep it. In this case you will receive an explanation of why we need to keep the data.
  • You can also request that we stop using your data while we consider a request to have it corrected or deleted. There may be some circumstances in which we are unable to do this however we will provide an explanation if this is the case.
  • In certain circumstances you may also request data we hold about you in a format that allows it to be transferred to another organisation.
  • In the event that decisions are taken using automated processes you have the right to request that these decisions are reviewed by a member of staff and to challenge these decisions.

    Please name two responsible referees who have known you for more than 2 years. References should be from separate sources and not from the same organisation or employer e.g., your current or most recent employer, a person who has knowledge of and can comment on your work with children, someone who knows you in a professional capacity. References cannot be accepted from a spouse, partner or family relation or from someone with whom you live. They must know of your experience of looking after children (observed you looking after children) and of your suitability to act as chaperone. They must not know you solely in connection with your dancing school or amateur dramatic organisation.

  • Disclosure and Barring Service
    Under arrangements introduced for the protection of children, Hertfordshire County Council will check with the Disclosure and Barring Service (DBS) for the existence and content of any criminal record. You will be required to complete a DBS Application to enable an Enhanced check to be made. Any criminal record may require an interview and Hertfordshire County Council reserve the right to refuse to issue a chaperone licence if it is considered that there is a safeguarding risk. If you are signed up to the DBS Update Service and have an enhanced children’s workforce and children’s barred list DBS check we may be able to use this service, if you give permission.   • Charges for a DBS
    Voluntary DBS (no payment received other than expenses) admin fee £22.80 includes VAT Professional DBS (payment received) DBS-£40 + admin fee £22.80 £62.80 includes VAT Chaperones will have regular contact with children so this role is exempt from the Rehabilitation of Offenders Act 1974. Therefore you are required to declare any convictions, cautions, bind-overs or prosecutions you may have, even if they would otherwise be regarded as ‘spent’ under this Act.

  • Do you have any convictions, cautions, reprimands or final warnings that are not "protected" as defined by the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (as amended in 2013) by SI 2013 1198?
  • Do you have an enhanced DBS certificate on the update service?
